Petitioner, already in custody, seeks bail in connection with Kutumba PS Case No.34 of 2017, registered under Section 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that the stolen motorcycle was recovered from one Niraj Kumar and not from this petitioner, Niraj Kumar disclosed that motorcycle was purchased from Anuj Kumar and on his confessional statement, name of this petitioner was disclosed, except that there is no other material and this petitioner has clean antecedent. Having considered the aforesaid facts and circumstances, petitioner Birju Rajwar @ Brijnandan Prasad
Patna High Court Cr.Misc. No.29916 of 2018(2) dt.15-05-2018 2/2 Rajvansi is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-VII, Aurangabad (Bihar) in connection with Kutumba PS Case No.34 of 2017.
