NILU AGRAWAL ORAL ORDER 10-12-2018 Heard learned counsel for the petitioner, learned counsel for the State, learned counsel for the Bihar State Food and Civil Supplies Corporation and the counsel for the Bihar State Co-operative Land Development Bank, Patna. Petitioner seeks payment of retiral dues along with arrears of salary, C.P.F., Gratuity and Leave Encashment. Petitioner was initially working as Field Officer and later was posted as Assistant Manager at Bhagalpur w.e.f. 17.04.2007 as a contractual/adhoc working arrangement for 11 months. Petitioner was made to retire on 07.07.2016 although he claims date of retirement was 15.12.2017 for which and for payment of
Patna High Court CWJC No.10296 of 2018(3) dt.10-12-2018 2/2 salary he had approached this Court earlier.
Considering the nature of prayer made in the writ application, this writ application is disposed of with a liberty to the petitioner to move the Managing Director, Bihar State Food and Civil Supplies Corporation, respondent no. 2 and the Managing Director Bihar State Cooperative Land Development Bank, respondent no. 4 for payment of his retiral dues which would be calculated and paid to the petitioner within a period of three months from the date of filing of such representation. If some of the dues are not admissible, the same shall be communicated by the respondent no. 2 and 4 by a speaking order to the petitioner through registered post. (Nilu Agrawal, J) devendra/- U
