The petitioner seeks regular bail in connection with Mithanpura P.S. Case No.32 of 2018 for the offences punishable under Section(s) 420, 379/34 Indian Penal Code. The allegation is regarding four unknown persons have changed the ATM Card of the informant when the daughter of the informant had gone to ATM for withdrawing a sum of Rs.2000/- and subsequently informant received a message regarding withdrawal of a sum of Rs.1,22,000/-.
The learned counsel for the petitioner submits that the petitioner is innocent and a simple person who is engaged in the work for denting and painting. It is further submitted that the petitioner has been falsely implicated in the present case by the
Patna High Court Cr.Misc. No.32048 of 2018 (2) dt.24-05-2018 2/2 police. The petitioner is stated to be languishing in custody since 07.03.2018.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate (West), Muzaffarpur in connection with Mithanpura P.S.
