JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-05-2018 Heard the learned counsel for the petitioners and the learned APP for the State.

The petitioners seek regular bail in connection with Aurangabad Town PS case no. 97 of 2018 instituted for the offences punishable under Sections 435, 436, 353, 153, 153(A) and other sections of Indian Penal Code.

The allegation is that on the occasion of procession of Ram Navmi, members of two religious community clashed with each other and indulged in arson and loot.

The learned counsel for the petitioners submits that large number of persons have been made accused in the present case but no specific overt act is attributed, even no

Patna High Court Cr.Misc. No.29600 of 2018 (2) dt.21-05-2018 2/2 incriminating material has been recovered from the possession of the petitioner. It is further submitted that co-accused person has already been granted bail by an order dated 14.05.2018 passed in Cr.Misc. no. 29086 of 2018.

Having regard to the facts and circumstances of the case, the abovenamed petitioners are directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) each with two sureties of the like amount each to the satisfaction of C.J.M. Aurangabad in connection with Aurangabad (Town) PS case no. 97 of 2018.
