JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 The petitioner seeks regular bail in connection with Bhangaha P.S. Case No. 25 of 2019, registered for offences punishable under Sections 341, 323, 447, 307, 302, 379 and 504/34 of the Indian Penal Code.

Allegation against the petitioner and other accused persons is that on the dispute of payment for orchestra programme, they assaulted the son of informant causing his death.

It has been submitted on behalf of the petitioner that no specific allegation has been attributed to the petitioner and he has been in custody for more than six months and chargesheet has been submitted and one of the co-accused having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 25.10.2019 passed in Cr.

Patna High Court CR. MISC. No.83413 of 2019(2) dt.16-12-2019 2/2 Misc. No. 54506 of 2019 and petitioner has been in judicial custody since 05.06.2019.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Narkatiyaganj, West Champaran/ or the concerned court, where the case is pending, in connection with Bhangaha P.S. Case No. 25 of 2019, subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required.
