2. The petitioner seeks bail in a case registered for the offences punishable under Sections 103(1), 61(2), 351(2), 3(5) of B.N.S. and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioners along with other co-accused persons and 5-6 unknown persons came at the house of the informant and fired from desi katta on the informant's husband, due to which he died on the way to hospital.
4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that there is no specific overt act against the petitioner. He further
Patna High Court CR. MISC. No.1349 of 2025(2) dt.12-02-2025 2/3 submits that there is specific allegation against co-accused Sonu Kumar, who fired upon the informant's husband. He submits that the petitioner has one criminal antecedent as mentioned in para-3 of this application and he is languishing in judicial custody since 15.09.2024.
5. Learned APP for the State and informant oppose prayer for anticipatory bail submit that the petitioner is the member of organized crime and one motorcycle was also recovered from the house of the petitioner.

Having regard to the facts and circumstances of the case and the fact that there is no specific overt act against the petitioner, let the above named petitioner, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Ramkrishna Nagar P.S. Case No.597 of 2024, subject to the conditions:
(1) One of the bailors will be his own blood relative, preferably, father, mother, brother, sister and/or his wife. (II) The petitioner shall not indulge himself in any similar offence till conclusion of the trial. (III) The petitioner will be well represented on each

(IV) The petitioner shall co-operate with the investigation, if not already concluded and make himself available and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail. (V) The petitioner will mark his attendance in the local police station in the first week of every month till conclusion of trial, failing which the prosecution will be at liberty to move cancellation of his bail bond.
