The petitioner seeks bail in Thakurganj P.S. Case No. 7 of 2018 registered under Sections 413 and 414 of the Indian Penal Code.
Two quintals of high tension wire is said to have been stolen from a pole. Said wire along with other articles were recovered from an Ambulance and the petitioner and other accused, namely, Imamuddin are apprehended, while other accused persons managed to escape.
It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the
Patna High Court Cr.Misc. No.31405 of 2018 (2) dt.22-05-2018 2/2 seized articles or with the aforesaid ambulance. He has been falsely implicated in this case by the police merely on suspicion while he was passing through the place of occurrence at the time of occurrence. He has no criminal antecedent. The petitioner has been languishing in custody since 15.01.2018. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Thakurganj P.S. Case No. 7/2018.
