The petitioner has prayed for bail in connection with Baruraj P.S. Case No. 180 of 2019 registered for the offence punishable under section 414 of the Indian Penal Code and section 30(a) of Bihar Prohibition and Excise Act, 2016. As per allegation in the FIR, 3251 litres of IMFL is said to have been recovered from about one dozen car, out of which 1017 litres of IMFL was recovered from the car of the petitioner.

It is submitted by learned counsel for the petitioner that the allegation of recovery is false and concocted. A number of co-accused, whose case stand on similar footing to that of the petitioner, have been enlarged on bail including vide orders

Patna High Court CR. MISC. No.81799 of 2019(2) dt.11-12-2019 2/2 dated 31.11.2019 passed in Cr. Misc. No. 69468 of 2019 and order dated 15.11.2019 passed in Cr. Misc. No. 70909 of 2019. It is further submitted that petitioner is in custody since 28.8.2019, has no criminal antecedent and charge sheet has been submitted in the case.

Having heard learned counsel for the parties and considering the facts and circumstances of the case especially in view of grant of bail to other co-accused and charge sheet having been submitted in the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Spl. Judge, Excise Act, Muzaffarpur in connection with Baruraj P.S. Case No. 180 of 2019.
