Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
The FIR of the occurrence of dacoity is against unknown. The impugned order reveals that only material against the petitioner is his confessional statement before the police while in police custody in connection with Jogbani P.S.Case No.201 of 2017.
Submission is that nothing incriminating has been recovered from possession of the petitioner nor the petitioner was ever put on T.I. Parade. He is in custody since 23.01.2018. Investigation of the case is already closed against the petitioner.
Patna High Court Cr.Misc. No.29142 of 2018 (2) dt.16-05-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Forbesganj Police Station Case No.386 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
