JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-05-2018 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek pre-arrest bail in connection with Khajekalan P.S. Case No. 80 of 2018 registered under Section 366 read with 34 of the Indian Penal Code. It is submitted by the learned counsel for the petitioners that the petitioners have been made accused in the first information report merely because they happen to be the parents of named accused Raja with whom the daughter of the
Patna High Court Cr.Misc. No.29701 of 2018 (2) dt.17-05-2018 informant aged about 21 years eloped. It is submitted that it is a case of forceful abduction rather it is a case of long standing relationship and affair between the daughter of the informant and the son of the petitioners regarding which, the petitioners came to know only after the daughter of the informant eloped with their son.
Learned counsel for the State opposed the application for grant of pre-arrest bail to the petitioners. Considering the submissions made above as also the fact that the first information report was instituted after five days of the alleged occurrence, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M, Patna City in connection with Khajekalan P.S. Case No.80 of 2018 subject to the conditions as laid down under Section 438(2) Cr. P.C.
