The petitioner seeks bail in connection with Shikarpur P.S. Case No.386 of 2019 registered under Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner along with Ankit Kumar Soni, Altaf Raza and Safi Alam were apprehended from a room by the police, in course of investigation of Sikta P.S. Case No.74 of 2019 in respect of the kidnapping of the co-accused Safi Alam. In the room, a bag was hanged in a wall from which one loaded country made pistol is said to be recovered. Further submission is that while the

Patna High Court CR. MISC. No.80206 of 2019(2) dt.06-12-2019 2/2 petitioner has been made accused in Sikta P.S. Case No.74 of 2019 but, in that case, the police has already submitted the final form. Except the aforesaid case, the petitioner has no criminal antecedent and, in the present case, the petitioner is in custody since 10.09.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Shikarpur P.S. Case No.386 of 2019.
