JUSTICE SANDEEP KUMAR ORAL ORDER 09-01-2024 By way of this writ petition, the petitioner has prayed for the following reliefs:- "For issuance of a writ in the nature of certiorari to quash the notice bearing letter No.922 dated 24.11.2023 because it is indicated that Mauza-Narayanpur, Thana No.325, Khata No.568, Khesra No.2931, Area 01 decimal public land has been encroached. The same encroachment case is pending for hearing in the Court of Respondent no.5."

The State is a party in the Title Suit No.1238 of 2023 pending before the Sub Judge, I, Bhojpur at Ara. 3.

The petitioner is given liberty to file an injunction application in the Title Suit No.1238 of 2023 within two weeks from today. If such an injunction application is filed within two weeks from today, the Sub Judge concerned will dispose of the same within one month from the date of its filing after hearing all the parties.

Till the disposal of the injunction petition, the structure of the petitioner shall not be disturbed. 5.

It is clarified that if the petitioner does not file injunction application within two weeks from today then the stay granted by this Court will automatically be vacated. 6.
