JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-01-2020 The petitioner seeks regular bail in connection with Sheosagar (Baddi) P.S. Case No. 17 of 2017, registered for offences punishable under Sections 147, 148, 149, 323, 435, 385 and 386 of the Indian Penal Code.
Allegation as per F.I.R. is that some accused persons came to the field of informant and set the poclane machine of the informant on fire by sprinkling K-oil and also assaulted the informant. Petitioner is not named in the F.I.R., later on his name transpired on confessional statement of co-accused. Apart from that petitioner is accused in three other cases. It has been submitted on behalf of the petitioner that save and except the confessional statement of the co-accused, there is absolutely nothing against the petitioner and he has been in judicial custody since 13.12.2018 and chargesheet has

Having heard both sides, in view of the above submissions, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Rohtas at Sasaram, in connection with Sheosagar (Baddi) P.S. Case No. 17 of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
