2. The petitioner is in custody in a case registered for the offence punishable under Sections 419, 420, 467, 468, 471 and 120(B)/34 of the Indian Penal Code.
3. As per prosecution case, the informant has purchased land bearing khata no.2167 and in his possession since last 40 years land bearing to new khata number 2169 was also the ancestral land of the informant and was in his possession and which was wrongly entered in the name of Mostt. Mahawati Kunwar in provisional survey and for which suit no.13/79 was instituted and the court found the entry in the
Patna High Court CR. MISC. No.1156 of 2025(4) dt.08-05-2025 2/3 name of Mostt. Mahawati Kunwar as wrong and order to enter the name of the father of the informant and his legal heirs in Khatiyan. It is further stated that the land Mafia of the area-19 named accused in the FIR including the accused petitioner with an intention to grab the ancestral land forcibly and illegally brought a forged Mahadname dated 20.02.2024 into existence and wants to dispossess the informant and kill the informant and his family members.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that the informant has neither got title and possession on the said land nor the informant is pattidar of late Mostt. Mahawati Devi and except the land dispute, no other allegation has been alleged against the petitioner. He also submits that this case is of purely civil in nature and no case is made out for committing the offences of cheating, forgery and criminal breach of trust and voluntarily causing heart as stated in para15 of the petition. Petitioner has got clean antecedent as stated in para-3 of the petition and he is in custody since 08.09.2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.
6. In view of the aforesaid facts and circumstances as
Patna High Court CR. MISC. No.1156 of 2025(4) dt.08-05-2025 3/3 also the submission of the learned counsel for the petitioner, so I am inclined to grant bail to the petitioner.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Lalganj P.S. Case No. 299 of 2024.
