The petitioner seeks regular bail in connection with Special Case No. 6944 of 2017 arising out of Bihta P.S. Case No. 784 of 2017, registered for the offence punishable under Sections 271, 272 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition Excise Act, 2016.

The allegation is regarding the police having apprehended several accused persons including the petitioner herein on the suspicion that they were indulging in the trade of illicit liquor.

The learned counsel for the petitioner submits that the petitioner is innocent and no recovery has been effected from the conscious possession of the petitioner. It is further

Patna High Court Cr.Misc. No.31627 of 2018(2) dt.31-05-2018 2/2 submitted that the petitioner is having a clean antecedent and he is languishing in custody since 16.03.2018. Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Bihta P.S.
