2. The petitioner is apprehending his arrest in Tajpur P.S. Case No. 314 of 2021 registered under Sections-30(a), 41(1), 41(2), 47 of Bihar Prohibition and Excise Amendment Act, 2018.
3. In the alleged occurrence, 3731.04 litres of illicit liquor is said to have been recovered.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in this case. The petitioner has been made accused in the present case on the basis of mere suspicion. The name of the petitioner has surfaced in this case on the basis of disclosure made by the
Patna High Court CR. MISC. No.86710 of 2025(2) dt.12-12-2025 2/2 apprehended co-accused Akhilesh Kumar.
5. On the other hand, the learned counsel for the State opposed the prayer for anticipatory bail by submitting that in huge quantity, illicit liquor is recovered in this case and the petitioner has criminal antecedent of similar nature.
6. Considering the aforesaid facts and circumstances, the petitioner is not entitled for privilege of anticipatory bail and accordingly, the same is rejected.
7. However, if the petitioner surrenders in the court below and seeks regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Nawneet Kumar Pandey, J) A.K.V.//- U T
