2. The petitioner seeks pre-arrest bail in connection with Mufassil P.S.Case No.517 of 2025, registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act.

3. As per the allegation made in the FIR total 437.400 ltrs. of illicit nepali liquor has been recovered from the old Godown, which is standing in the name of co-accused Arun Mishra.

4. Learned counsel appearing on behalf of the petitioner submitted that the petitioner has clean antecedent. Petitioner is innocent and he has been falsely implicated in the present case. Learned counsel further submitted that the

Patna High Court CR. MISC. No.85976 of 2025(2) dt.18-12-2025 2/3 petitioner has not been apprehended at the place of the occurrence. On these grounds, the learned counsel seeks the petitioner to be released on pre-arrest bail.

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that total 437.400 ltrs. of nepali liquor has been recovered and the petitioner has no criminal antecedent, the petitioner is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Bettiah, District West Champaran in connection with Mufassil P.S.Case No.517 of 2025, subject to the conditions as laid down under Section 438(2) of the Cr.P.C./Section 482(2) of BNSS.

7. The learned district court is directed to verify the criminal antecedent of the petitioner and if it is found that the petitioner is involved in some other cases as what has been stated in paragraph No.3 of the bail application, this order will automatically lose its force.

8. The Superintendent of Police, West Champaran is directed to submit a report before the Director General of Police (Bihar) and the Chief Secretary, Government of Bihar as to why he is not able to control the trade of illicit liquor within his jurisdiction.
