2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 341 , 323 , 307, 379, 504, 506 and 34 of the Indian Penal Code .

3 . As per the prosecution case , on the alleged date and time of occurrence , all the F.I.R., named accused persons including this petitioner assaulted three brother of informant on account of which they sustained injury .

4. Learned counsel for the petitioner submits that informant is not an eye witness to the alleged occurrence . No such occurrence as alleged has ever taken place . As a matter of fact, due to dispute over loading and unloading of passengers, some altercation took place among the Toto Drivers including

Allegation of assault is general and omnibus against this petitioner. Petitioner claims clean antecedent. 5 . Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts, clean antecedent of the petitioner and other circumstances of the case , in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate Nawada in connection with Nawada Town P.S. case No. 709 of 2024 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure .
