====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 09-12-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Ara (Town) P.S. Case No.454 of 2019 registered under Sections 307, 448, 341, 323, 379, 504 and 506/34 of the Indian Penal Code.

The accusation is that on 21.08.2019 at about 02.00 P.M., when the informant was sleeping at his house, at that time, Hariom Bhardwaj came there and started to abuse, saying that why the sand has been put in the motorcycle. Thereafter, Hariom Bhardwaj, threw the inverter and locked the main gate of the house of the informant. In the meantime, both the

No.80488 of 2019(2) dt.09-12-2019 2/2 petitioners also reached there and caught hold of the informant and took him away at their door, where Hariom Bhardwaj caused injury at the head of the informant through iron rod. Learned counsel for the petitioners submits that while the petitioners are named in the F.I.R. but the specific allegation to cause injury at the head of the informant through iron rod is against Hariom Bhardwaj. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Ara (Town) P.S. Case No.454 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C.
