KUMAR ORAL ORDER 23-05-2018 Heard learned counsel for the petitioner and the State. Petitioner seeks pre-arrest bail in Motipur P.S. Case No.135 of 2018 instituted for the offences under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Excise Act. Allegation is of recovery of 170 liters of toddy from the house of the petitioner.

Learned counsel for the petitioner submits that the license of toddy stands in the name of his full elder brother, namely, Vijay Mahto which has been renewed up to 31.3.2019 and the petitioner lives in joint venture in joint house. He does not have any criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender

Patna High Court Cr.Misc. No.31080 of 2018 (2) dt.23-05-2018 2/2 before the court below within six weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of Special Judge Excise Act,Muzaffarpur, in Motipur P.S. Case No.135 of 2018 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
