JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-06-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Sessions Trial No. 174 of 2019/ 198 of 2019 arising out of Rajouli P.S. Case No. 324 of 2018 for the offenses under Sections 25(1-b)a, 26 of the Arms Act and Section 4/5 of the Explosive Substances Act.

Learned counsel appearing on behalf of the petitioner would submit that the petitioner has earlier approached this Court in Cr. Misc. No. 32059 of 2019 which was rejected on 14.5.2019 with an observation that 'petitioner may renew his prayer for bail after six months in the event no substantial progress is made in the trial. More than one year has elapsed since then.

No. 32059 of 2019, the Court is inclined to grant bail to the petitioner. Let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-10th, Nawada in connection with Sessions Trial No. 174 of 2019/ 198 of 2019 arising out of Rajouli P.S. Case No. 324 of 2018, subject to the condition that on release the petitioner shall render his services as volunteer to combat the pandemic of Covid-19 for a period of one month. He is required to report to the Civil Surgeon/ Nodal Officer, Covid-19, Nawada, who shall utilize his services appropriately.
