The petitioners seek bail in Naokothi P.S. Case No. 18 of 2018 registered under Sections 302 and 120B of the Indian Penal Code.
Petitioners and three other accused persons are said to have assaulted the brother of the informant namely Shravan Singh by means of rod making him injured. The victim succumbed to his injury during the course of treatment. It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. They have no concern with the aforesaid occurrence. They have been falsely
Patna High Court Cr.Misc. No.31426 of 2018 (3) dt.24-05-2018 2/2 implicated in the case due to land dispute. Allegation levelled against the petitioners is not specific rather general and omnibus in nature. Gotiya of the deceased namely Hareram Singh telephonically informed the P.S. about assaulting the deceased by some criminals, but he had not named the petitioners in the occurrence. Subsequently, they manipulating and setting up the story falsely implicated the petitioners in the occurrence due to animosity. The petitioners have been languishing in custody since 26.03.2018.
Considering the facts aforesaid, the above named petitioners are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Begusarai in connection with Naokothi P.S. Case No. 18 of 2018.
