2. The petitioner seeks regular bail in connection with Phenhara/Fenhara P.S. Case No.170 of 2022 lodged under Sections 341, 323, 354b, 307, 448, 506/34 of the I.P.C. read with Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 16.04.2024 passed in Cr. Misc. No.10154 of 2024 in which liberty was granted to him to renew his prayer for bail 6 months after framing of charge.

4. Learned counsel for the petitioner further submits that the charge has already been framed in this case on 11.06.2024, 6 months lapsed after framing of charge and trial

Patna High Court CR. MISC. No.2320 of 2025(3) dt.12-02-2025 2/3 has also been commenced.

5. Counsel for the petitioner submits that petitioner is in custody since 11.10.2023 having 2 criminal antecedent.

6. Learned counsel for the State opposes the prayer for bail and submits that it is true that the charge has already been framed in this case.

7. It is made clear that the petitioner is suffering from HIV positive as asserted by the counsel for the petitioner in paragraph 12 of the bail petition.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, on being satisfied by the trial court that the petitioner is not absconding in any of the cases which are pending against him whose details are mentioned below, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M./Concern Court, Motihari, East Champaran in connection with Phenhara/Fenhara P.S. Case No.170 of 2022, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.

9. The details of the cases which are pending against the petitioner, are as follows:-
