The petitioners apprehend their arrest in connection with Raghopur P.S. Case no. 74 of 2017, registered under Sections 304 (B)/ 201/ 34 of the Indian Penal Code. The accusation is of killing of the daughter of the informant by her husband and in laws due to none-fulfillment of demand of dowry and remove her from matrimonial house. Learned counsel for the petitioners submits that petitioner No. 1 is brother-in-law and petitioner No. 2 is fatherin-law of the deceased, daughter of the informant. Further submission is that, in fact, daughter of informant died due to
Patna High Court Cr.Misc. No.32025 of 2018(2) dt.14-06-2018 2/2 suffering from diarrhea and in the knowledge of the informant her dead body was disposed off, but with ulterior motive, the present case has been lodged. Moreover, Montu Rai, husband of deceased, is in custody. The co-accused Vinod Rai has already been allowed privilege of pre-arrest bail on 4.5.2018 vide Cr. Mice. No. 27194 of 2018 by a Co-ordinate Bench of this Court.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-IV Vaishali in connection with Raghopur P.S. Case No. 74 of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
