The petitioner, in the present case, is seeking regular bail in connection with Sandesh P.S. Case No.48 of 2018, registered for offences alleged under Sections 25(1-b)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is neither owner nor the driver of the vehicle in question from which the arms and live cartridges have been recovered. It is submitted that there is no recovery from his conscious possession, he has no criminal antecedent and he is languishing in jail since 04.04.2018.
Learned APP for the State is present.
Patna High Court Cr.Misc. No.31937 of 2018 (2) dt.11-06-2018 Considering the facts and circumstances and the recovery is from the vehicle and the petitioner has no criminal antecedent, let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IX, Ara in connection with Sandesh P.S. Case No.48 of 2018, subject to the conditions U/S 437(3) Cr.P.C.
