The petitioner is in custody since 12.02.2018 in connection with Birpur P.S. Case No. 294 of 2016 for the offence registered under Sections 147, 149, 341, 323, 325, 307, 302 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is general and omnibus allegation against all the accused persons and the petitioner is said to be the member of the crowd. It is further submitted that no specific role has been attributed to the present petitioner and other similarly situated co-accused persons have since been extended the privilege of bail in Cr. Misc. No. 8126 of 2017 vide order dated 24.03.2017.

Patna High Court Cr.Misc. No.34139 of 2018 (3) dt.16-07-2018 Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of District and Sessions Judge, Supaul in connection with Birpur P.S. Case No. 294 of 2016.
