The petitioners apprehend their arrest in connection with Kishanpur P.S. Case No. 33 of 2017 for the offence punishable under Section 307 and other allied sections of the Indian Penal Code.

The allegation is regarding the accused persons having assaulted the informant, his wife and daughter resulting in simple injury being inflicted upon them.

The learned counsel for the petitioners submits that as far as the petitioners are concerned, there is no allegation of any kind of specific overt act and they are not stated to have

It is further submitted that the injuries suffered by the informant and others are simple in nature. It is further submitted that the petitioners are having a clean antecedent and as far as the petitioner no.1 is concerned, she is female and 54 years old and the petitioner no.2 is aged about 79 years old.

Having regard to the facts and circumstances of the case, in the event of arrest or surrender in the court below within a period of four weeks from today, the petitioners above named are directed to be released on anticipatory bail on furnishing bail- bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Kishanpur P.S. Case No. 33 of 2017, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
