Petitioner has surrendered in connection with Deepnagar P.S. Case No. 176 of 2017 for offence under Sections 30, 30(a) and 41 of Excise Act, 2016.

Learned counsel for the petitioner submits that petitioner has no criminal antecedents and his name figured on the confessional statement of the co-accused. Learned counsel for the petitioner submits that similarly circumstance two other co-accused, whose name have been surfaced on the confessional statement of co-accused, have been released on bail by the Court below itself.

Considering the fact that petitioner has no criminal antecedents and other two co-accused have been granted bail, let
