In this case, the petitioner is seeking anticipatory bail in connection with Kishanpur P.S. Case No.238 of 2016 (G.R. No.2168 of 2016), registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 504 and 506 of the Indian Penal Code.
Allegation has been made that the accused persons including the petitioner have surrounded the informant and assaulted him. Allegation has been against the petitioner to have caused injury on the finger of Devan Yadav by sword. Looking to the nature of injury as also the fact that there is case and counter case from both the sides, let the petitioner, namely, Badri Yadav, be released on anticipatory bail
Patna High Court Cr.Misc. No.37259 of 2018(2) dt.04-07-2018 2/2 in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Supaul, in connection with Kishanpur P.S. Case No.238 of 2016 (G.R. No.2168 of 2016), subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. Further condition is that whenever the police will call the petitioner for the purposes of investigation and interrogation, he will remain present for the investigation. In the event of being absent on two consecutive dates without reasonable explanation, the present order will be treated to have been cancelled.
