Petitioner apprehends arrest in connection with Kanhauli P.S. Case No. 20 of 2018 registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016. Learned counsel appearing for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner. The alleged recovery is from a public road. Petitioner has been implicated in this case on the basis of confessional statement of co-accused. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.33352 of 2018 (2) dt.07-06-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. II Cum Special Judge, Excise Act, Sitamari in connection with Kanhauli P.S. Case No. 20 of 2018 subject to the conditions laid down under Section 438(2) Cr.P.C.
