The petitioners seek pre-arrest bail in connection with Tikapatti P.S. Case No. 107 of 2019, registered under Sections 363, 365 and 34 of the Indian Penal Code.

The accusation is that Udai Kumar Singh, son of Sadanand Mandal, who is a graduate, use to talk on mobile withNeha Kumari (petitioner no. 3), daughter of Ranjan Sharma (petitioner no. 1). On 18.09.2019, Udai Kumar was asked by the petitioners to come at their house, then, Udai Kumar went there, thereafter, he was kidnapped under conspiracy.

Submission is that while occurrence of kidnapping is said to be of 18.09.2019, but, the informant has lodged the present case after six days, i.e., on 24.09.2019. In fact, Udai Kumar, who is son of the informant used to tease Neha Kumari (petitioner no. 3), and

No.82206 of 2019(3) dt.26-06-2020 2/2 also used to give pressure to perform marriage, but, protest was made by the family members for which Complaint Case No. 2031 of 2019 was filed in the Court of the Chief Judicial Magistrate, Purnea, due to fear Udai Kumar left his house and went to Bengaloru, where his friend use to reside and returned from there and his statement, under Section 164 of the Criminal Procedure Code, was also recorded on 03.10.2019 in which he has only stated about his kidnapping by Ranjan Sharma (petitioner no. 1) and Rajesh Sharma. The petitioners have no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioners, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Tikapatti P.S. Case No. 107 of 2019 shall be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
