The petitioners seek regular bail in connection with Ramgarhwa P.S.Case No.217 of 2019 instituted for the offences punishable under Sections 309 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. Allegation is that from the possession of petitioner Pappu Singh, a small knife and mobile phones were recovered, whereas from possession of other petitioners, only one mobile was recovered. They were arrested on suspicion when they were preparing for committing dacoity.

Patna High Court CR. MISC. No.80609 of 2019(2) dt.13-01-2020 2/2 Submission is that petitioners are in custody since 04.10.2019. Investigation of the case is already complete. Considering the fact that there is no substantial material against the petitioners nor there is no allegation that the petitioners are going to tamper with the evidence or abscond the process of law, let the above named petitioners be released on regular bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul, East Champaran at Motihari in connection with Ramgarhwa P.S.Case No.217 of 2019, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners and also that the petitioners shall not leave the country without permission of the Court.
