25-06-2018 Heard Sri Dhirendra Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 06-11-2017, as stated in paragraph - 8 of the petition, in Kotwali P.S. Case No. 600 of 2017 registered for offence under Sections 18/21(b)/22(I)/28/29/30 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that in this case, petitioner has been made accused on an accusation of recovery of 5 iwfM+;k (pudiya) of smack without indicating the weight of so called smack. It has been argued that in any event, the material found from the petitioner can be considered as small quantity.

Considering the nature of accusation and the period of

No.33814 of 2018(2) dt.25-06-2018 2/2 custody as well as the fact that petitioner is having clean antecedent, which fact has been stated in paragraph - 3 of the petition, let the petitioner namely Ganesh Paswan be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District and Sessions Judge IIIrd cum Spl. Judge, C.B.I. II, Patna in connection with Kotwali P.S. Case No. 600 of 2017 (Spl. Case No. 169 of 2018).
