JUSTICE ARUN KUMAR ORAL ORDER 25-06-2018 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner, already in custody, seeks bail in connection with Kajra P. S. Case No. 36 of 2017, registered under Sections 302 of the Indian Penal Code.

Allegation in brief is that the petitioner had earlier quarreled with his brother, subsequently the brother of the deceased assaulted on the head of the husband of the informant by iron rod, causing death.

Learned counsel for the petitioner submits that the petitioner is own brother of the deceased and he has been falsely implicated in the case. It is further submitted that the petitioner has no any criminal antecedent and is in custody since 14.10.2017.

Patna High Court Cr.Misc. No.33773 of 2018 (2) dt.25-06-2018 2/2 Learned A.P.P. opposes the prayer for bail on the ground that there is specific allegation against the petitioner, who is sole accused for killing of his own brother. Having considered the said facts, circumstances and in view of specific allegation against the petitioner, his prayer for bail stands rejected.
