JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-01-2020 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 2889 of 2016, corresponding to Trial No. 2039 of 2019, instituted for the offences punishable under Section 498A of the Indian Penal Code and Section 4 of Dowry Prohibition Act.
As per complaint case petitioner happens to be husband of the complainant and there is allegation against him of demand of one motorcycle and for that he tortured her.
Submission of learned counsel for the petitioner is that complainant is in habit of fleeing away from the house and he has filed a divorce case against her before the Family Court and for that the present case has been filed and complainant has also filed Maintenance Case No. 211 of 2016 in the Family Court, Saran at Chapra, in which petitioner has appeared.

In view of above facts and circumstances, let petitioner, in the event of surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Saran at Chapra, in connection with Trial No. 2039 of 2019, arising out of Complaint Case No. 2889 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that petitioner has to co-operate in disposal of the above maintenance case and he has to abide by any order, either interim or final, passed by learned Family Court, Saran at Chapra, who is directed to expedite the disposal of the same. Let a copy of this order be communicated to the Principal Judge, Family Court, Saran at Chapra.
