The petitioner seeks bail in anticipation of his arrest in connection with Tikapatti P.S. Case No. 107 of 2019 dated 24.09.2019 instituted for the offences under Sections 363, 365 and 34 of the Indian Penal Code. Because of the affair between the daughter of the named accused persons of this case viz. Ranjan Sharma and Soni Devi, the son of the informant was abducted for some time. When the son of the informant returned, he made his statement under Section 164 Cr.P.C. in which he has named the petitioner also as having abducted him.
Regard being had to the aforesaid fact, I am not inclined to grant anticipatory bail to the petitioner.
Patna High Court CR. MISC. No.80205 of 2019(2) dt.16-12-2019 2/2 Accordingly, the prayer for anticipatory bail is rejected.
However, should the petitioner surrender before the court below and seek bail, the court below shall take into account the fact that there was some relationship between the boy and Neha Kumari, who too has been made accused in this case and that after some time of the confinement, the son of the informant came back home and shall pass orders in accordance with law without being prejudiced by the fact that the present petition has not been entertained.
With the aforesaid direction/observation, the petition is disposed of.
