2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30(a), 44 ( b ) of Bihar Prohibition and Excise (Amendment ) Act 2022 . 3 . As per prosecution case , 99 liters country made chulai liquor was recovered from seized tempo .

4. It is submitted that the petitioner is innocent and the name of the petitioner transpired during course of investigation only on the basis of confessional statement of the co-accused persons who was apprehended on the spot. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got one criminal antecedent of similar nature in which he is on bail.

6. Considering the facts of the case , in the event of arrest/surrender within eight weeks from today , let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court, Excise - 2 Nawada in connection with Excise Police Station Case No. 620 of 2024 , subject to the conditions laid down under section 482 ( 2 ) of BNSS 2023 .
