Petitioner seeks bail in a case registered for the offences punishable under Sections 364 and 365 of the Indian Penal Code.

Allegation in the complaint based F.I.R. is that the petitioner kidnapped to the son of the informant namely- Ram Ekbal Raut for the reason that the petitioner had illicit relation with the wife of Ram Ekbal Raut.

Submission is that the complaint petition was filed in the year 2017, whereas co-accused Kavita Devi had already filed a case of maintenance against her husband vide Maintenance Case No.08 of 2016 before the court of learned

Patna High Court Cr.Misc. No.35509 of 2018 (2) dt.27-06-2018 2/2 Principal Judge, Family Court, Sheohar vide Annexure-2. In that case the victim of kidnapping was already contesting, and order dated 28.01.2018 would reveal that he was examined as witness no. 1 on behalf of Opposite Party.

Considering the background and nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sheohar Police Station Case No.14 of 2018, subject to the condition that both the bailors shall be resident of within the territorial jurisdiction of the court below and the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
