The petitioner is in custody since 21.01.2018 in connection with Rail Sasaram P.S. Case No. 4 of 2018 for the offence registered under Section 414 of the Indian Penal Code and Section 137 of the Railway Act.

Learned counsel for the petitioner submits that only because the petitioner had alighted from the train with a bag on the basis of suspicion the petitioner has been taken into custody. It is further submitted that the petitioner has no criminal antecedent.
