2. The petitioner seeks regular bail in connection with Madhepura Excise P.S. Case No. 106 of 2023, lodged on 12.02.2023 under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

3. As per the prosecution case, there were four persons who were made accused in this case. Total 259.20 litres of illicit foreign liquor was recovered from the vehicle which is the subject matter of the present case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel also submits that the petitioner is nowhere named in the FIR and he is also not the registered owner of the said vehicle rather,

No.5324 of 2024(2) dt.07-02-2024 2/2 during investigation, it has come that he has taken the said vehicle on lease for one year and it is due to this reason, the present petitioner has been made accused in the present case. Counsel submits that the petitioner is subject to conspiracy. Counsel further submits that the antecedent of the petitioner is clean and he is in custody since 31.10.2023.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

In the present facts and circumstances of this case and the submissions made above considering the antecedent of the petitioner, let the petitioner above named, be granted bail, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cumSpecial Judge, Excise-II, Madhepura in connection with Madhepura Excise P.S. Case No. 106 of 2023.
