Petitioners, already in custody, seek bail in connection with Ekma PS Case No.165 of 2012, giving rise to Sessions Trial No.284 of 2015 registered under Sections 302/34 of the Indian Penal Code as well as under Section 27 of the Arms Act. Learned counsel for the petitioners submits that the allegation in the FIR is specific only against Rakesh Singh who shot at the informant's son and not against the petitioners; the police after investigation did not sent up the petitioners for trial, however, under Section 319 Cr.P.C. petitioners have been summoned and similarly situated other co-accused were granted anticipatory bail after summoning order.

No.36035 of 2018(2) dt.22-06-2018 2/2 Having considered the aforesaid facts and circumstances, petitioners, namely, Sunil Singh and Sujit Singh are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge, 2nd, Saran at Chapra in connection with Ekma PS Case No.165 of 2012, giving rise to Sessions Trial No.284 of 2015.
