The petitioner, who is in custody since 16.10.2019, seeks bail in connection with Sidhwalia P.S. Case No. 190 of 2019, dated 15.10.2019, instituted for the offences under Sections 399, 402, 413 and 414 of the Indian Penal Code, Sections 25(1-b)A, 26(1) (2) and 35 of the Arms Act and Sections 8(C), 20(b) (ii) (B) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Patna High Court CR. MISC. No.80868 of 2019(4) dt.04-06-2020 2/2 assembled at a particular place for committing an offence, a raid was conducted and the petitioner along with others were arrested. From the possession of other accused persons, various incriminating materials in the shape of firearm weapons and narcotics in small quantity was recovered. However, from the possession of petitioner, only one mobile telephone without a SIM card has been recovered. Considering the nature of accusation against the petitioner and taking into account the fact that he does not have criminal antecedents as well as his period of custody, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge-I, Gopalganj in connection with Sidhwalia P.S. Case No. 190 of 2019. The application stands allowed.
