JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-12-2019 This is an application for grant of anticipatory bail in connection with Kishanganj (Mahila) P.S. Case No. 15 of 2018, registered for the offences punishable under Sections 376, 323, 506 and 34of the Indian Penal Code and Section 4/6 of POCSO Act.

As per F.I.R., allegation of forcible rape on the coaccused Zulfekar Alam on the point of knife to the informant who is a minor and further allegation is that when the accused persons including the petitioner went to the house of the informant, they have assaulted the informant. Submission of learned counsel for the petitioner is that so far as the allegation of rape is concerned is against other co-accused and there is allegation against the petitioner of assault and asking the informant to abort the pregnancy.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, Kishanganj in connection with Kishanganj (Mahila) P.S. Case No. 15 of 2018, subject to the condition laid down under Section 438(2) of the Cr.P.C to co-operate in the investigation.
