Petitioner, already in custody since 18.1.2018, seeks bail in Ara Town PS Case No. 23 of 2018, registered under Sections 414, 401, 420, 467, 468, 471 and 120B of the IPC.

The allegation in brief is that the police apprehended one Md. Arif with a stolen motorcycle, he disclosed names of other members of his gang engaged in stealing motorcycle and leading to that several motorcycles were recovered from other accused. Submission is that except disclosure of name of the petitioner that he is one of the member of the gang there is no other material, no stolen motorcycle was recovered from his possession and he bears a clean antecedent.

Learned Counsel for the State also concedes that there is no recovery of motorcycle from the possession of the petitioner. Having considered the said facts and circumstances, the petitioner Md. Saif Haider is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of CJM Bhojpur at Ara in connection with Ara Town PS Case No. 23 of 2018.
