Petitioner is in custody in connection with Sessions Trial No. 97 of 2019 arising out of Sitamarhi P.S. Case No. 772 of 2018 for the offence under sections 364, 302/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that other co-accused, namely, Nek Mohammad @ Md. Nek Mohammad Ansari has been granted bail by a coordinate bench of this Court in Cr. Misc. No. 11627 of 2019 vide order dated 30.01.2019.

The petitioner is in custody since 7.8.2018.

Considering the fact that petitioner has no criminal

Patna High Court CR. MISC. No.84216 of 2019(3) dt.27-05-2020 2/2 antecedent and other co-accused has been granted bail, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing his personal bond to the satisfaction of learned Fast Track Court-II, Sitamarhi, in connection with Sessions Trial No. 97 of 2019 arising out of Sitamarhi P.S. Case No. 772 of 2018 on account of total lock-down due to Covid-19 pandemic.
