2. The petitioner seeks regular bail in connection with Belhar P.S. Case No. 107 of 2023 registered for the offence under Sections 420, 468, 471, 120B of Indian Penal Code.
3. As per the allegation in the FIR, the accused petitioner entered with an agreement with the informant to sell the land for Rs. 10,40,000/- and he executed agreement to sell after receiving Rs. 5,40,000/- and after some time he denied executing the sale deed and with an intention to return through a cheque and the cheque when deposited in concerned bank, the cheque got bounced.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.1470 of 2024(3) dt.19-03-2024 2/2 petitioner is innocent and has falsely been implicated in the present. He is in custody since 08.10.2023.
5. However, learned APP for the State vehemently opposed the prayer for regular bail. Learned counsel for the informant submits that both the parties have compromised this case and the matter is settled.
6. Considering the aforesaid facts and circumstances of the case and also taking into account the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Belhar P.S. Case No. 107 of 2023.
