The petitioner apprehends his arrest in Bhaptiyahi P.S. case No. 126/2017 for the offences punishable under Section s 304(B), 201, 120(B) and 34 of the Indian Penal Code. The informant alleged that his daughter was married to Dilip Kumar Yadav, son of Raghubans Yadav, in the year 2004 but her husband and other in laws continued to torture her. His daughter disclosed the entire story on telephone. On 06.12.2017 Manoj Yadav and Ranjeet Yadav, closed relative of Raghubans Yadav, came to his house and informed him that his daughter fled away in the early morning from the house.
The learned counsel for the petitioner submits that petitioner is brother in law of the daughter of the informant. The
Patna High Court Cr.Misc. No.35181 of 2018 (2) dt.04-07-2018 2/2 informant did not make any sort of allegation against the petitioner. The marriage was solemnized in the year 2004 and after 13 years the father of the victim made allegation of demand of dowry and torture. The death of the victim is still doubtful.
Taking into consideration the facts that the petitioner is brother in law of the daughter of informant and no specific allegation of demand of dowry and torture is made against the petitioner, other accused persons have already been granted anticipatory bail even husband has been granted bail, the petitioner above named in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Bhaptiyahi P.S. case No. 126/2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
