ANJANA MISHRA ORAL ORDER 02-08-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 25.04.2018 in connection with Manjhagarh P.S. Case No.92 of 2018 registered for the offence under Sections 341, 323, 307, 504/34 of the Indian Penal Code.
Mr. Yogesh Chandra Verma, learned Senior Counsel appearing for the petitioner submits that though the allegation is of repeated attack on the person of the nephew of the informant, the injury report, which has come, indicates only one injury and not many, as has been described in the F.I.R. Learned Senior Counsel thus submits that such an injury report entirely belies the prosecution case and entitles the petitioner to
Patna High Court Cr.Misc. No.36624 of 2018 (3) dt.02-08-2018 2/2 the privilege of bail. He further submits that the petitioner is not having any criminal history. The entire case has been lodged on suspicion as, admittedly, the informant is not an eye-witness. In view of the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gopalganj, in connection with Manjhagarh P.S. Case No.92 of 2018.
