====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 15-04-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 302, 313, 504, 506/34 of the Indian Penal Code.

3. As per prosecution case, informant was married to Rajiv Kumar (deceased) in the year 2023 and thereafter, after discovering her husband's affair with his sister-in-law, informant returned to her paternal house due to which, sister-in-law of the informant used to quarrel with the deceased. It is alleged that on 7.05.2024, the accused persons threatened the father of informant to kill the husband of informant and later on, dead

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Informant is not an eye witness of the occurrence and petitioners are simply victims of over-implication. He further submits that due to dispute between the couple, the deceased committed suicide. F.I.R. has been lodged after inordinate delay of two days which itself raises doubt over veracity of the prosecution case.

However, learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioners are named in the F.I.R. and during course of investigation, witnesses have supported the prosecution case. Furthermore, as per report of the doctor, cause of death is 'Asphyxia due to Throttling'.

6. Considering the nature of accusation and gravity of the offence, prayer for bail of the petitioners is refused. (Prabhat Kumar Singh, J) Navya/- U T
