2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 109, 61(2) and 3(5) of B.N.S and Section 27 of the Arms Act.
3. The case of the prosecution is that certain unknown miscreants have made fire due to which brother of the informant has received gun shot injury.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that the FIR was lodged against unknown miscreants. During course of investigation, Vivek and Sumitesh have given their confessional statement and the name of this petitioner has come in their confessional statement. Learned counsel for the petitioner has further submitted
Patna High Court CR. MISC. No.86480 of 2025(2) dt.17-12-2025 2/2 that the brother of the informant has received one gun shot injury whereas the allegation is against eight persons. He has also submitted that Sumitesh Kumar @ Golu on whose confessional statement, the name of this petitioner has surfaced, has already been granted bail by this Court vide order dated 01.12.2025 passed in Cr. Misc. No. 66451 of 2025. The case of this petitioner stands on similar footing. Moreover, the petitioner is languishing in judicial custody since 15.08.2025.
5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail and submitted that petitioner is having criminal antecedent of three cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Saharsa Sadar P.S. Case No. 609 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa.
